This downed custom Harley was the victim of a maniac making a U-turn through a break in the center divider. The driver of the car that made the U-turn claimed my client was speeding, and the insurance company trotted out the skid mark angle again. Luckily, photos obtained from a witness at the scene, taken at the time of the accident, showed so many skid markes from so many vehicles that it became apparent no one could say which skid mark was which. The rider suffered a fractured pelvis, fractured left forearm and facial fractures resulting in one eye almost falling out. The case settled. Gnarly!
Recently, I accepted a left-turn accident case that also involves a product case against Buell Motorcycles. As you may or may not know, Buell motorcycles are constructed with the fuel in the frame. There is no fuel containment system so there is the potential for a fuel spill and fire on impact. In the case I am currently handling, the Buell motorcycle rider was severly burned.
